GENERAL TERMS AND CONDITIONS

APPLICATION OF LAW

    

  • In the event that the company makes an indulgence to the client this shall not be deemed to be a waiver of any of the company's rights, nor shall it limit the company's right to exercise any of it's rights.

  • All agreements shall be deemed to have been made in South Africa and shalll be interpreted in terms of South African law.

  • In the event of a legal action, the client agrees to the Randburg Magistrate's Court or the South Gauteng High Court having jurisdiction.

BOOKINGS AND CANCELLATIONS

    

  • The company reserves the right not to confirm any booking until the full amount has been paid.

  • In the event that the company is required to change a booking because of either the unavailablity of permits or unsafe weather conditions, the company reserves the right to reschedule the booking to another appropriate time rather than refunding the client.

  • If the client cancels an excursion (single day trip) less than 7 days before the trip is scheduled to commence then the client shall only be entitled to a 50% refund, subject to the provision below dealing with cancellations less than 24 hours before the scheduled start of an excursion.

  • If the client cancels an excursion (single day trip) less than 24 hours before the trip is scheduled to commence then the client waives any right to any refund.

  • If the client cancels a multi-day trip less than 10 days before the trip is scheduled to commence then the client shall only be entitled to a 50% refund, subject to the provision below dealing with cancellations less than 7 days hours before the scheduled start of a trip.

  • If the client cancels a multi-day trip) less than 7 days before the trip is scheduled to commence then the client waives any right to any refund.

  • The tour or course price includes only those items specified in the itinerary or course prospectus. The client assumes responsibility for all costs not stipulated as included.

  • In the event that the company is required to cancel a trip or a course completely, the client is entitled to a full refund.

RISK MANAGEMENT

    

Adventure implies risk and uncertainty. The client hereby acknowledges and accepts that:

  • The client acknowledges that the activities offered by the company are adventurous and  it is up to the client to ensure that they are adequately fit for the adventure that they elect to undertake.

  • It is impossible to guarantee absolute safety at any time, and even less so when hazardous pursuits are deliberately undertaken. While the company shall strive to manage the risk down to an acceptable level it makes no guarantees of absolutel safety.

  • There will be times when the company is required to postpone a trip or alter the itinerary in order to reduce risk and, when such measures are undertaken the client accepts that such changes do not constitute a breach of contract, nor do they form grounds for a claim for reimbursement.

  • The consumption of alcohol or certain medications (whether prescribed or not) may hamper the client's abaility to follow instructions or may hamper their personal ability to judge risk. The client therefore agrees to refrain from the consumption of alcohol or of any medication with a psychological effect or side-effect before or during high-risk activities such as rock climbing, abseiling, canyoing, ice climbing, winter high-altitude trekking and the like.

  • Clients are required to possess travel insurance or medical aid, depending on whether they are foreign nationals or South African citizens.

MEALS AND DRINKS

    

  • Unless otherwise expressely stipulated, meals and drinks are not included as part of excursions or courses.

  • Where meals and drinks are included, these will be expressely stated in the INCLUSIONS portion of the itinerary.

TRAINING COURSES AND ASSESSMENTS

    

When a client has enrolled in a training course or a skills assessment, the following provisions shall apply:

  • The client acknowledges that not all training courses conclude with an assessment for competence. The client further acknowledges that assessment for competence may entail a separate event involving a separate payment.

  • Enrolling for an assessment for competence does not guarantee a finding of competence.

  • Certain training courses have a fitness prerequisite attached to them. These fitness requirements are communicated to the learnr before they enrol for the course, as part of the course prospectus. A learner who has enrolled for a course and is unable to meet the fitness requirements of the course may be discharged from the course with no expectation of a refund.
